Ontario status certificate requirements

How long an Ontario condominium corporation has to deliver a status certificate, what the fee cap is, and what a late delivery is taken to mean.

What this duty is

A status certificate is the corporation's written answer to a purchaser about a unit and about the corporation itself: arrears, increases, special assessments, litigation, the reserve fund, the insurance.

The period is short, it is counted from the request and the fee together, and the fee itself is capped by regulation, so a corporation cannot buy itself more time by charging more.

Missing it is worse than embarrassing. The statute treats a corporation that does not deliver in time as having stated that there are no arrears, no increases and no special assessments, whether or not that is true.

Who is responsible, and when it is due

The rules pack puts this on the Treasurer.

Due 10 days after the date of the triggering event.

This duty counts from something only your corporation holds, so it has no worked example from a fiscal year end alone. Inside Board Butler it is dated from your own records.

What happens if you miss it

If the certificate is not delivered within 10 days of the request and fee, the corporation is deemed to have certified that there are no arrears, no increases in common expenses and no special assessments as of the request date.

The pack records no monetary penalty for this one, which does not make it cheap: the cost usually arrives later, through a purchaser, a lender or a tribunal.
