Ontario condo budget notice requirements

When an Ontario condominium board must adopt next year's budget and deliver it to owners, and what happens if the year starts without one.

What this duty is

The budget for the coming year has to be adopted and in owners' hands before that year begins, so that the contributions owners are asked for on the first of the year have an adopted budget behind them.

The date is counted back from the fiscal year end, which means a corporation with a June year end is doing budget season in spring while its neighbour with a December year end is doing it in autumn.

This is also the deadline that quietly drives the rest of the year. The periodic information certificate reports the budget, and it cannot report a budget that does not exist yet.

A duty is met when there is something to show for it. The rules pack requires a recorded board decision, and proof that the notice actually reached owners.

Common expense contributions for the new year have no adopted budget behind them, and the periodic information certificate cannot report the budget.
