Chapter 718 and Chapter 720: the obligations that differ and the ones that do not
A Florida condominium and a Florida homeowners' association run on different chapters. Most of the shape is the same and the details that differ are the ones boards get wrong.
What is the same in both
Under Chapters 718 and 720 alike:
Board meetings need notice, posted where the statute says and for the period it sets.
There is an annual meeting, an election procedure, and a budget that has to be adopted on a schedule.
Directors must complete a certification requirement after taking office.
Official records must be kept and made available for inspection.
What differs
Where the two chapters part company:
The competitive bid threshold: a percentage of the total annual budget for condominiums, a higher percentage for homeowners' associations.
The official records list, the excluded categories and the website posting duty are written separately in each chapter.
Reserve treatment, and the structural integrity reserve study, apply to condominium buildings rather than to every association.
A worked year for Palm Harbor Villas
Palm Harbor Villas is a 140-unit townhome homeowners' association. From its fiscal year end the butler places the budget meeting and its notice, the annual meeting and election sequence, the director certification deadlines, the posting duties and the inspection obligations.
